side note: per my niece (a server), cash is always best for tips… also, if I was aware a place did that, I would Venmo or CashApp the server directly

a restaurant here in Charleston was fined and ordered back pay, because the restaurant can't force a tip pool to pay the back of the house.

I know it may very state to state. But typically employers can’t touch servers tips and even a signed agreement allowing that may be illegal as well.

restaurant worker here.... it's legal... they could be taking the tip for things like bus Boys, bartender etc. boss only has to ensure minimum wage
