Some investigations are very straight forward and some are incredibly complex. Sometimes there isn’t an obvious solution, so HR may talk through a few different choices for outcomes with the leader or leaders. HR may often lead the investigation, but HR doesn’t run companies. Just as marketing may gather data and makes recommendations to leaders based on that data, leaders may not take their recommendations. HR is also like that. There have been a number of times I believed someone needed to be fired, but leaders didn’t agree so they didn’t get fired. And there have been a number of times I thought someone should not be fired, but leaders didn’t agree so they got fired. And yes, I escalate these situation to senior leaders. Leaders run companies. HR does not. Leaders are in charge, HR is not. And if you say, “well at my company, HR is in charge,” it’s only because leaders are letting them and agreeing with their decisions. Leaders could simply override HR at any time. Sometimes HR isn’t leading the investigations. Another leader or department might be. And HR may be there to take notes or to act as another set of eyes. I’ve partnered with other leaders, the Security dept, another HR professional, or Compliance on investigations. But generally speaking, HR’s role is to gather information and makes recommendations.
