BIGAMY. Bigamy is the act of entering into a marriage with a person while legally married to another person. In simple terms, Bigamy is when a married person goes on to marry another person while the previous marriage still exists/subsists. E.g. A, being married to B, still goes on to marry C when in fact the marriage with B still holds. Practicing Bigamy in Ghana is an offence for which the offender would be jailed for 3 years or less. However, Bigamy is not a crime if the previous marriage was done through the traditional process (Engagement). Bigamy is also not an offence if at the time of the subsequent marriage his former wife or her former husband has been continually absent for seven years, and has not been heard of by him or her as being alive within that time. The civil law doesn’t embrace BIGAMY and marrying a person under the ordinance law marriage simply means that you have agreed to stay with the person for the rest of your life. And if your flesh desires the flesh of another, then you’re to call for a dissolution before remarrying and that’s one of the reasons for criminalising Bigamy in Ghana.
