Unfortunately, to avoid an accident it must be done safely. So while they have reasons to sue the Sedan, the SUV is liable.

Sedan driver should have licensed suspended for sure! Suv had enough time & space to avoid. Sedan had foot on brake didn’t slam. Suv is my guess!
