Undisclosed conflict of interest, especially in collusion with police, can taint the entire case, invalidating probable cause and leading to the suppression of evidence under the "fruit of the poisonous tree" doctrine. Such misconduct can also be grounds for a false arrest lawsuit.  Probable cause and the "fruit of the poisonous tree" Probable cause: This is the legal standard required for a lawful arrest, search, or warrant. It is a reasonable belief, based on specific facts and circumstances, that a crime has been committed and that the person to be arrested committed it. It must be more than a mere suspicion or hunch. Conflict of interest: For a prosecutor, a conflict of interest exists when their personal beliefs, relationships, or interests could interfere with their duty to serve the public interest and ensure justice is done. This could include a close, co-dependent relationship with the police agency or an undisclosed relationship with a victim or witness. The "poisonous tree": When a prosecutor is driven by a hidden conflict rather than the pursuit of impartial justice, it can be argued that the entire legal proceeding is tainted from the start. The conflict of interest acts as the "poisonous tree". The "fruit": Any evidence or actions that result from this conflict, including the establishment of probable cause and a subsequent arrest, can be considered the "fruit of the poisonous tree". Effect on probable cause: If probable cause was obtained or fabricated by police officers conspiring with a conflicted prosecutor, a court could determine that the probable cause was a product of the unlawful conspiracy. In this scenario, the arrest would be retroactively considered invalid, as it stemmed from an illegal "poisonous tree".  False arrest and malicious prosecution A false arrest claim asserts that a person was unlawfully detained without probable cause. While the existence of probable cause generally protects law enforcement from such claims, misconduct can change that analysis. If a conspiracy between police and a conflicted prosecutor manipulated the legal process to secure a baseless arrest, it could support a claim of:  False arrest: A successful false arrest claim would argue that the probable cause was manufactured improperly, making the arrest illegal from its inception. Malicious prosecution: A malicious prosecution claim addresses situations where legal proceedings are initiated or continued without a good faith basis and for an improper purpose. If a conspiracy to conceal a conflict of interest was used to continue a case against a defendant, it could form the basis for this type of lawsuit.  Potential consequences of a conspiracy If a conspiracy between police and a prosecutor to conceal a conflict of interest is discovered, several outcomes are possible: Exclusion of evidence: A judge could rule to suppress all evidence tainted by the illegal conspiracy, potentially leading to the dismissal of charges. Prosecutorial recusal: The prosecutor's office could be required to appoint a special prosecutor to handle the case, or the case could be referred to another jurisdiction to avoid the appearance of impropriety. Civil lawsuits: The defendant could pursue a civil rights lawsuit under 42 U.S.C. § 1983 for false arrest and malicious prosecution, holding the officials accountable for their malicious and bad-faith actions.
