Rep. Matt Gaetz (R-FL) accused the Justice Department of a double standard by bringing charges against former President Trump for his handling of classified documents while declining to prosecute President Biden and his ghostwriter, Mark Zwonitzer, who deleted audio recordings of the president talking about having classified material. “What does somebody have to do to get charged with obstruction of justice by you,” Rep. Gaetz asked former Special Counsel Robert Hur. “If deleting the evidence of crimes doesn’t count, what would meet the standard?” Mr. Hur noted that Mr. Zwonitzer cooperated with the investigation, including providing transcripts that contained the key passages from the same recordings, which he concluded in his report “suggest that his decision to delete the recordings was not aimed at concealing those materials from investigators.” The Florida lawmaker also pressed Mr. Hur on one of the reasons he decided not to bring charges against the sitting president: that he could not prove intent. Mr. Hur concluded in his report that a jury would likely find the president to be a “sympathetic, well-meaning elderly man with a poor memory.” Mr. Hur said, based on the evidence, he would not be able to prove beyond a reasonable doubt to a jury that the intent element had been met. “But the reason you have that doubt is the ‘senile cooperator theory,’ the fact that Joe Biden is so inept in responding that you can’t prove the intent,” Rep. Gaetz said.
