@imtheproblem: URGENT: she’s about to lose her house - background she is already paying the large percentage of the mortgage alone, she gets a small amount per month (worked out outside court) for the kids. Does she have any right with the house or does she need to sell up now? The kids under 5. Thank you so much!!! #familylaw #divorcetok #foryou #fyp #fypシ
if he is the biological parent he should be paying the mortgage til the youngest finishes full time education. she needs to speak to a solicitor asap. also if her name is on the deeds/mortgage she

If his name is on the mortgage he is also legally responsible for the debt. She can claim it as part of the marital assets. He either has to pay half or buy her out of the house.

I think it depends on if he can AFFORD to pay the mortgage and live separately. If not the house will need to be sold. I was in a similar situation. My ex spiralled into addiction and stopped working

Don’t concern yourself :
Sell the property, the lender doesn’t care who pays as long as they do.

she needs to contact a mediator , if the dad refuses mediation then she can go to a solicitor and the courts will say he needs to pay . unfortunately he can't be forced though if he still refuses

By law dad has to pay what the Csa say which is about 20% of his monthly income. If he’s not paying that amount she can do a claim thru the Csa who’ll take it directly from his pay cheque & charge him
