@kylaleelawyer: Replying to @gettajob can the parents of the baby who died in a motor vehicle accident sue the driver? The answer in British Columbia is no. ##DangerousDriving##DrivingLaw##Insurance##CivilLawsuit##ICBC##ICBCDumpsterFire##KylaLee##DrivingLawyer##TrafficTicket
In BC there is only one provider for vehicle insurance and that the Insurance corp of BC. It’s an organization that is difficult to deal with because you can’t go anywhere else.

I had no idea about the BC law. That is deeply tragic and an infuriating denial of even the pursuit of justice

So why are we paying for $3 million liability on our auto insurance?

Why am I encouraged to buy extended coverage on top of ICBC coverage I have $2 million extra coverage would that not cover liability in a case like this

Can you sue the BC government because they're limiting recourse in matters like this?

I thought you cannot sue ICBC but you can legally file a civil suit against the driver? And why do you need a criminal conviction to pursue a civil law suit?

No no, money is not justice nor would the driver be able to pay regardless. The fault is with the system where someone can kill another and face no penalty. Money is not a penalty

If the civil lawsuit was able to proceed and the defendant lost, who would pay? ICBC or the driver?

Just Wondering :
We can be appalled by the lack of a criminal conviction here. The law limiting civil suits was to save the rate payers money due to lawyers taking icbc cases in contingency to make money frivolously.

I'll sleep at night knowing premiums are drastically reduced at the expense of personal injury lawyers and opportunists tbh.ICBC will still pay out what people actually need.

So the lawyers are out millions of dollars because they can’t sue an innocent person. Insurance companies would love for you to sue so they don’t have to pay as well. Sue the prosecutors!

I agree with the ban on law suits - in BC people are so rich that it would cause major problems if the province had to settle those
