The Senate on Wednesday failed to advance a bill to safeguard access to contraception, with the 51–39 vote falling short of the 60 needed to start debate. Two Republicans — Sens. Susan Collins (ME) and Lisa Murkowski (AK) — joined Democrats in supporting the measure. Senate Majority Leader Chuck Schumer (D-NY) switched his vote from yes to no so that he can offer a motion to reconsider at a later date. The bill, which would codify the right to contraception into federal law, was first introduced in 2022 after the Supreme Court eliminated the constitutional right to an abortion with its decision in Dobbs. The measure was not expected to pass but was called up for a vote to highlight the issue of reproductive rights heading into the November elections. Republicans criticized the move as a “show vote,” arguing that contraception isn’t under attack in the country. “This is continuing the campaign of fear mongering we’ve already seen. Contraception is available in every state across the nation,” Sen. Katie Britt (R-AL) said. “The goal of my Democratic colleagues right now is to scare the American people, to scare women across our great nation.” Sen. Schumer pushed back, saying the bill was needed due to recent legislative efforts that have curbed access to reproductive health care. “To those who think that federal action protecting access to birth control is unnecessary, just look at what’s happening in states like Virginia and Nevada and Arizona, where Republicans are openly blocking these very protections,” he said ahead of the vote.
