Letter from Traditional Affairs General F Masemola National Police Commissioner, SAPS, Private Bag X94 Pretoria 0001 Subject: THE ROLE OF THE SAPS IN THE IMPLEMENTATION OF SECTION 7(9) READ WITH SECTIONS 7 AND 8(3)(a) AND (b) OF THE TRADITIONAL AND KHOI-SAN LEADERSHIP ACT, 2019 (ACT NO 3 OF 2019) The Traditional and Khoi-San leadership Act, 2019 (Act 3 of 2019) (TKLA) was assented to by the President on 20 November 2019, published in Government Gazette No. 42865 on 28 November 2019 and its implementation commenced on 01 April 2021. The Act has repealed the Traditional Leadership and Governance Framework Act, 2003 (Act No. 41 of 2003) and the National House of Traditional Leaders Act, 2009 (Act No. 22 of 2009). Section 7 of the Act provides for recognition of different positions of traditional and Khoi-San leaders and legal processes leading to the recognition of a person as a traditional and Khoi-San leader and the legal authority to recognise different levels of traditional and Khoi-San leadership. In terms of section 7(1)(a) of the TKLA there are four positions of traditional leadership, namely, king/queen, principal traditional leader, senior traditional leader and headman/headwomen. In terms of section 7(1)(b) of the TKLA, there are two positions of Khoi-San leadership, namely, a senior Khoi-San leader and branch head. In terms of section 8(3)(a) and (b) of the Act, a king or queen is recognised by the President of the Republic of South Africa by publishing a notice in a government gazette and issuing a certificate of recognition to the king or queen. All the other traditional and Khoi-San leadership positions below a king or queen (i.e.. principal traditional leader, senior traditional leader, headman/headwomen, senior Khoi-San leader and branch head) are recognised by the Premier of the Province concerned by publishing a notice in a provincial gazette and issuing a certificate of recognition to the leader. Therefore, any person claiming to be a legally recognised king or queen must have a certificate of recognition signed by the President and his/her name published in a government gazette recognising the person as such. Similarly, any person claiming to be a principal traditional leader, senior traditional leader, headman/headwomen, senior Khoi-San leader and branch head must have a certificate of recognition signed by the Premier of the Province concerned and his/her name published in a provincial gazette recognising the person as such. In terms of the law, the President and the Premiers of provincial governments cannot delegate the functions of recognition of traditional leaders at all levels to any person. Therefore, the South African Police Service has a critical role to play in the implementation of this provision of the new law. The previous laws that were repealed by the TKLA did not have this provision, hence the matter may have not been previously reported to the South African Police Service. Since it is now a criminal offence in terms of the new law, members of the community and recognised traditional leaders may report this criminal activity to the South African Police Service. This letter therefore serves to notify the South African Police Service of this legal provision. Furthermore, the purpose of this letter is to request the South African Police Service to act on the matter when reported or already reported cases. The Department further requests the National Police Commissioner to share the content of the letter with Provincial Commissioners.
