The spelling with one “n” was one of the acceptable forms in 1787. I can’t speak to the grammar, but In general language and grammar evolves. we now only use one space after a “.” It used to be two.

Spelling in English was not rigidly standardized back then, but was still meandering along on its way to standardization. For the Revolutionary generation, spelling was still a largely a matter of preference. For example, Jefferson chose to spell "choose" as "chuse" and did not spend a single night in jail for it.
