if tower is closed, it becomes Class E, so the pilot just needs to advice that he is landing.. there is nothing illegal here

Nothing about this is illegal. An ATC cannot refuse to allow a plane to land . They can specify they are not currently handling traffic and you can land at your own risk but will get it done safely.
