Well there R 2 issues here. If she was paying all childcare expenses while he was gone it’s fair she would recover his share. However, basing future payments on a COLA he no longer receives is wrong.

I was deployed and got divorced after coming back. My ex put reason for divorce was abandonment. Judge asked where I was for 18 months. I said Iraq. He dismissed it and had her refile.

Appeal the judge’s decision. This is a difficult endeavor but not impossible. I assume an appeallat court would look deeper into the details than a local judge.

I don’t know about with child support but COLA, BAH, BAS are all none taxable and are not considered income. So they shouldn’t have used it in the income ruling.

Guy I deployed with didn’t have any child support taken out of his checks. His BM refused to accept money over cashapp etc. he saved all the payments ready to give her 13K cash when we got back.

wasn't there a ruling that said that parenting time and payments are not connected. mother denied father parenting time but he still has to pay, payments did not go up

Base pay didn't change. Allowances are not pay but are for the individual to house and eat. Those should not be used to calculate child support. He should've still paid child support.

Judge said it was for a year,about the time he was deployed. He can go back to court then and get it modified back to original amount. Probably fair

I think the judge should have done a little math and figured out what he owed while overseas and increase the child support a little until the areas were paid off.
