legal obligations in Victoria if they owner has intent to sell without tenancy, they have to give you 60days plus 7 days to mail you the notice. so legally 67 days notice is the requirement.

Unfortunately there isn't much you can do. When this happened to us we asked for a month extra after the lease was supposed to end.

In NSW I was given a formal 90 day notice in writing. I had signed a 12 month lease and had been there for over 2 yrs.

I’m in property management on the GC and this is normal practice. A minimum 2 months notice is required from owner/agent and must be in line with the lease expiry unless periodic agreement

Yeah you don’t have any “rights” in this situation other than seeing out the rest of the lease. You would be entitled to longer if you had already sent back the new lease agreement.

I believe in qld it’s 2 months notice a landlord is required to give and a tenant is required to give 2 weeks notice. Not sure if that’s the same if there wasn’t a signed new lease in place.

I would call RTA! They would be the most helpful with laws regarding this but I'm not sure you can do too much as the contract hadn't been signed yet. This seems very stressful so I wish you luck 😭❣️

Just because a lease ends does not mean your tenancy ends. If they haven’t issued the F12 then you are not required to move. Mp must give you 2 months notice in writing.

What part of the coast are you on? I just told in Caloundra. Moved to Aura. In Nirimba. It’s the most affordable. There are HEAPS of rentals there, newly built. Beautiful schools, a new private one.

Pretty sure they can’t physically kick you out if you are looking. They need to then go through eviction process which will buy u time but it also goes against your name for future applications so 😬

They typically send a notice to leave with your tenancy renewal, so that the lease is definitely terminated at the end if you haven't signed the new contract. 60 days notice is all that's required

Is the house already up for sale? As if they are advertising it as a vacant house you may have grounds in the buys may have grounds to put the real estate in breach of a contract.
