DAY 14: THE COMMONWEALTH RESTS — BUT HAVE THEY PROVEN THEIR CASE? After 14 days of testimony and nearly 70 witnesses, the Commonwealth has rested its case against Lindsay Clancy. And now comes the question I think every person following this trial should be asking: What, exactly, has the Commonwealth proven beyond a reasonable doubt? Today’s final witness was digital-forensics expert Ian Whiffin, who testified about Lindsay’s phone and Apple Watch data. The Commonwealth pointed to searches involving medications, depression, suicide and other mental-health topics, as well as device data showing movement inside the home around the time of the killings. But the defense also highlighted some important limitations. The Apple Watch stopped recording activity for a period of time. The witness could not say whether the watch was turned off, whether the battery died, or why the recording stopped. And some of the movement data could have been generated by the phone rather than the watch itself. (CT Insider) And this is where I think the Commonwealth’s case deserves a hard look. We know the children died. We know Lindsay was responsible for their deaths. But the central issue for this jury isn’t simply WHO did it? It is whether Lindsay was criminally responsible for what she did. The defense has spent this trial pointing to a documented history of psychiatric symptoms, multiple medications, hospitalizations, providers, reported hallucinations and a deteriorating mental state. So I expected the Commonwealth to give the jury a much clearer answer to the question: Why does all of that evidence NOT amount to reasonable doubt about her mental state at the time of the killings? Instead, we have heard a great deal about what Lindsay searched, what she did, what she said, what she appeared to understand and how she behaved. But organized behavior does not automatically mean someone was mentally well. Searching for information about suicide does not automatically tell us WHY someone was searching. And the fact that someone can perform purposeful actions does not, by itself, answer the legal question of whether they understood the wrongfulness of their actions. The Commonwealth may believe they have connected those dots. I’m not convinced they did. That doesn’t mean Lindsay should be found not criminally responsible. It means the defense doesn’t have to prove she was insane. The Commonwealth has to prove criminal responsibility beyond a reasonable doubt. And after 14 days, I’m still waiting for them to clearly show the jury where that line was crossed. Now it’s the defense’s turn. And I have a feeling this is where this trial gets REALLY interesting. What do YOU think the Commonwealth proved—and what do you think they failed to prove? #LindsayClancy #LindsayClancyTrial #ClancyTrial #TrueCrime #TrueCrimeCommunity
