The House failed Tuesday evening to impeach Homeland Security Secretary Alejandro Mayorkas, falling short of the simple majority needed to approve articles of impeachment and delivering a stunning defeat to Speaker Mike Johnson (R-LA).   The vote was tied at 215–215 as time expired on the clock after three Republicans — Reps. Ken Buck (CO), Mike Gallagher (WI) and Tom McClintock (CA) — bucked their party’s leadership by voting against impeachment.   Rep. Blake Moore (R-UT), the vice chair of the Republican conference, then switched his vote to no so that he could offer a motion to reconsider the resolution at a later time.   Last week, the House Homeland Security Committee approved two articles of impeachment against Secretary Mayorkas that charge him with “willful and systemic refusal to comply with the law” and “breach of public trust.”   The first charge centers on the secretary’s implementation of two administration policies: “catch and release,” which allows migrants apprehended at the border to be released into the country while they await legal proceedings; and humanitarian parole, a longstanding authority that allows border officials to let migrants into the country for special cases during emergencies or global unrest.   The second charge accuses Secretary Mayorkas of making false statements and failing to comply with congressional investigations into his actions.   Throughout a nearly three-hour floor debate, Republicans said the secretary should be removed from office for failing to uphold the law, while Democrats cast the whole exercise as political theater and abuse of the impeachment mechanism.   Even if Republicans can impeach him in the future, he would almost certainly be acquitted in the Democratically controlled Senate.   Only one cabinet secretary has been impeached in U.S. history: Secretary of War William Belknap, who was impeached in 1876 over corruption allegations related to military trading posts.
