correct in your assessment! In my area we would rebuild it and leave an air gap to breathe. but code is at least four inches of masonry around the flu. use some type of expansion joint in your cap too

no cavity the chimney needs to breathe expand and contract plus the crown has to have a wash on top brick mason 38 years i see a lot of this and rebuild is the only option

So glad ur rebuilding a brick fireplace with actual flue tiles! Seal the top when done. If Water gets in and it freezes, you’ll have problems. I keep my chimney sealed and drain water away as well.

I know very little about chimneys (I’m a contractor though). Something tells me the gap in the flue where it transitioned from angled to plumb was a problem as well.
