@hr_explained: Replying to @offical_politicians_suck Regardless of how a company manages their leaves of absence, I expect managers can explain FMLA, ADA, PWFA and any other leave law or disability law in their state. Maybe not to the degree HR does, but enough clear info that an employee understands what they may be able to obtain and why. HR or a TPA may manage the process. But they aren’t there managing a manager’s team and noticing who may be in need in the absence of them making a clear request. A clear request for FMLA or ADA isn’t needed in order for the employer to be obligated to provide the information. Managers get paid to manage. This includes explaining policies to employees. HR is a partner and can assist. And the manager may need to check with payroll or HR regardinf leave balances. I would challenge you that it’s not their job to know employment law. We can train them on how to ask questions and also know what not to say and ask, but ultimately HR helps with the legal stuff.

I’ve been in HR for 30 years - while I agree that managers need to manage, and they should be aware that it exists, I do not agree that managers should be explaining FMLA, ADA, etc.
