Try more like $100k—and even more for the other party—just to get to mediation, with ongoing negotiations for a couple of months afterwards to finalise a deed settlement. It wasn’t a family provision case, but I did challenge the validity of a dodgy will based on testamentary capacity. What we’ve learned is that it’s surprisingly easy to get away with formalising a dodgy will, whereas a dodgy bank cheque would have been investigated immediately. We’ve also come to realise that “you need to know the answers to the questions you don’t even know you need to ask!” It’s messy, complicated, time-consuming, and very expensive. Essentially, avoid any litigation at all costs—you’ll haemorrhage legal fees. On a side note, we effectively ‘won’ at mediation, even when the odds were well and truly stacked against us, and we were told that only 5% of these cases succeed. Very, very fortunate.

My two children were left their fathers home His partner contested the will and got the lot even though he had made provision for her to stay in the home until she died. What is the use of having a will if your wishes aren't carried out

I did Probate many years ago & it was easy to contest cause costs came out of estate. So glad that time changed. Harder to challenge these days if you're not financial

if a family member contests a will but they legitimately have no grounds (eg. they can't prove they need the money, were unfairly left out or that the will is illegitimate) can they still take it to court?

Been through it with my family,we have a family business, my dad left everything to me, my siblings took me to court, spent 200k in 6 months, it gets messy, after you don't talk to your family.

That doesn't seem fair that the other party has to pay as well. What happens if it's only a small cash amount, less than legals first fee! with no realestate .
