Few points for me. She handcuffs a guy, and places him in the rear of her cruiser. He immediately should have been pat searched. The weapon removed and then he placed in the vehicle. Secondly-

17yrs on the job. No one has ever gotten in my cruiser with out a search. Even a courtesy ride earns you a pat down.

the use of force is reasonable but officer precious needs to be fired and the back up officer need training for not immediately correcting the problem as soon as she told them he hadn't been searched

I agree it was justified but I’m sure the fact he wasn’t searched violated policies. I would never place someone in the back of my car without searching them.

Is it possible they were following guidance from the 10th circuit? I know that search incident to arrest can mean something different everywhere and if he was just detained then maybe they didn’t

They absolutely should have searched him. But at the end of the day, he still tried to use it so it is what it is.

I understand when a person is hard to place in cuffs, we control their movements and place them in the prisoner compartment, but there was opportunity to pat down especially when there is back up.
