Rep. Anna Paulina Luna (R-FL) said she will force a vote Friday to direct the House sergeant-at-arms to arrest Attorney General Merrick Garland for refusing to comply with a congressional subpoena. "If we, as a Congress, do not have the ability to enforce our investigative ability, that we are essentially going to be ignored and undercut and essentially handicapped by all other branches," she said in a press conference Wednesday. Her "inherent contempt" resolution relies on an obscure, rarely used process that allows each chamber to detain and bring to trial individuals found to be obstructing Congress's duties. Congress has not invoked the power since 1934, when it resulted in a lawyer getting a 10-day jail sentence for failing to comply with a Senate subpoena. Attorney General Garland earlier this month defied a subpoena issued by House Republicans to turn over the audio recordings of President Biden's interview with Special Counsel Robert Hur, leading to the House voting nearly along party lines to hold him in contempt of Congress. The Justice Department subsequently announced it would not prosecute the attorney general, arguing that Republicans' request for the material was illegitimate and would jeopardize future investigations. Mr. Hur concluded the president "willfully retained" classified information following his term as vice president but declined to bring charges, citing as one reason his belief that a jury would likely find the president to be a "well-meaning, elderly man with a poor memory." Democrats strongly objected to Mr. Hur's characterization of the president's mental acuity, while Republicans have seized on it as evidence he is unfit for office. The White House asserted executive privilege over the tapes on the attorney general's last day to comply with the subpoena, saying Republicans only wanted the recordings "to chop them up" and use for political purposes. Rep. Luna's inherent contempt resolution is very unlikely to get the support needed for passage as several Republicans have said they would oppose it.
