Special Counsel Robert Hur concluded President Biden “willfully retained and disclosed” classified military and national security information but he will not recommend criminal charges after completing a yearlong investigation into Mr. Biden’s handling of documents. “We conclude that no criminal charges are warranted in this matter,” he said in a report released Thursday. “We would conclude the same even if there was no policy against charging a sitting president.” The probe found that Mr. Biden retained classified material after his vice presidency, including documents related to military and foreign policy in Afghanistan and handwritten notes about national security issues that implicate sensitive intelligence sources and methods. “However, for the reasons summarized below, we conclude that the evidence does not establish Mr. Biden’s guilt beyond a reasonable doubt,” the report said. Mr. Hur, a former U.S. attorney nominated by President Trump, was named special counsel by Attorney General Merrick Garland in January 2023 after classified documents were found in Mr. Biden’s private office as well as his garage in Wilmington, Delaware. The special counsel’s team wrote that Mr. Biden’s memory was “significantly limited” in the interviews they conducted with him, adding that he would likely present himself to a jury as “a sympathetic, well-meaning, elderly man with a poor memory.” “It would be difficult to convince a jury that they should convict him — by then a former president well into his eighties — of a serious felony that requires a mental state of willfulness,” the report said.
