Lily also stated that the elderly man had his fishing poles raised while approaching the group and described him as "whipping" one of the poles toward Annay Martucci, prompting her to deploy the bear spray a second time. According to Lily, after the recording ended, the group retreated to their vehicles. She alleges the elderly man then approached Annay's vehicle, punched the driver's side window, kicked the car, and picked up rocks as though he intended to throw them. The group then left the scene, and police later responded to their residence to investigate. Lily stated that everyone in the group cooperated with law enforcement and alleged that the elderly man falsely told officers he had been "minding his own business when he was assaulted." She further stated that no arrests have been made and that investigators have forwarded the case to the District Attorney's Office for review. According to Lily, responding officers indicated they believed prosecutors would likely decline to file charges based on the available video evidence.
