HOA should have put a lien on previous owner so they can’t sell. They failed. Get a judgment against other owner. Title insurance should clear it for current owner.

To me, that is the whole reason why HOA should never be. They should be dissolved completely. They take an entitlement that is not theirs, or anybody else's
