Michael McDonald gets 0%…of his own song? 😳 Buckle up for a long & winding “interpolation” mystery!  Here’s what we know: Brill building legends Lieber & Stoller wrote a song called “I Keep Forgettin’” in 1962 (there’s a 3rd songwriter as well, but for now lets put aside why Gil Garfield’s name was dropped from the story). Chuck Jackson cuts a version, as do Procol Harum, David Bowie and Ringo Starr.  In 1982 Michael McDonald releases “I Keep Forgettin' (Every Time You're Near)” which, in the original release, is credited to him and Ed Sanford. Cut to 1994: Warren G.’s “Regulate” comes out, the label proactively clears the MM sample and adds McDonald and Sanford to the writing credits.  At some point along the way, outside of the public eye so we don’t know exactly when, Lieber & Stoller’s publishers make a few calls and essentially convince MM’s publisher to give up the entirety of that song’s copyright to them.  That’s right, the public records (MLC/Songview etc) show that McDonald’s “I Keep Forgettin’” is now 100% credited to Lieber and Stoller. In essence it’s considered a derivative work, almost like a cover, or a remix. This might have been a buyout, with retroactive payments for the years they were uncredited - again, its all done behind closed doors, so unless Stoller or a member of his team gets interviewed (Lieber passed in 2011) we may never know the details.
