Lindsay Clancy’s lawyer cited Karen Read’s case today when he asked that the deadlocked jury be asked if they’ve ruled out any charges. Read is a Massachusetts woman who was accused of hitting her boyfriend, John O’Keefe, a Boston police officer, with her car and killing him. Read’s first trial ended in a mistrial in July 2024 because the jury couldn’t reach a unanimous verdict. Several jurors said afterward that they unanimously agreed Read was not guilty of second-degree murder and leaving the scene of personal injury and death but were deadlocked on manslaugher. Read’s lawyers argued she could not be tried for murder and leaving the scene, but the Massachusetts Supreme Judicial Court held that an acquittal requires an announced, formal verdict affirmed in open court.” Read went to trial a second time and was acquitted in June 2025 of all counts except driving while intoxicated. In Clancy’s case, Reddington wants the judge to ask deadlocked jurors if they’ve unanimously decided any counts before he declares a mistrial. If they have decided counts, he wants the verdicts recorded so she can’t be retried on those counts. Jurors heard 22 days of testimony before beginning deliberations last Thursday. They are to decide if if she’s guilty of murder and if it’s premeditated or second-degree. Jurors also can consider manslaughter as a lesser included offense to murder. Judge William Sullivan said today at 11:30 a.m. he’ll declare a mistrial after the jury said, “It is with a heavy heart that we report we are unable to come to a unanimous decision, and will not be able to,” but he gave Reddington an hour to petition to Supreme Judicial Court to stay the decision so the jury can be polled on whether they’ve decided any of Clancy’s charges. #law #crime #court
