Rediculous that the ATO wasted tax payer’s money on pursuing this in court.

this happened to my husband. Audited last year. Refused all his expenses. He didnt have to go to court but we had to pay our accountant for hours of extra work to go through every receipt and relodge.

You can claim $85 a day without showing any receipts if you prove with your logbook you were away

the interesting thing about this specific case was that the individual didn’t technically win his argument but rather the ATO’s proposed $19 was deemed to be absurd in comparison to

I hope he had his court costs covered any lawyers fees as well as loss of income for the days he had to attend court. We live on the road so people can eat and have a roof over their heads. Absolutebs

audited in 2020 during covid. sent log books to ato, legal document. if you're not getting a refund of $10,000 as a long distance truck driver find a better accountant or do it yourself. up to 5000 kms to take your clothes, fridge, tools, bedding etc without keeping a receipt in your personal vehicle to and from work.i was the little guy and I won. cost the tax man extra 1.5k on return per year. fuck the greedy government scumbags.

It’s true for meal allowances but if you’re getting paid an “Overnight Allowance” you can’t claim because they’re different.

I’ve just had the same thing come up.Rarely I work away from home but I’m pretty sure I get meal allowance if I work late (o/t). I received approx $1300- for meal allowance in a year and I was asked by my accountant to prove what meals I had each time I worked away or worked o/t. I need to at least provide proof of how much I spent on each and every meal. Not an approx value, but provide receipts or bank statements. It’s a bit hard to determine this with bank statements since so many business trade under a different name to what appears on a statement. I need to come up with 3 years worth of proof for a couple of late tax returns as well. 😒

Unless engaged in commerce on the roads. You don’t have to pay tax. Clearly says in the tax act. Paying tax is VOLUNTARY. So 🛑STOP🛑paying tax.

And the ato should have to pay for all expenses for him to take it to court and they should pay damages if it has affected his mental health but dragging him through this and lost days of work by having to be audited etc.
