Why does Mnisi need to read every single page of the record when he was present from the start? The charges against all accused are the same save for a few charges. All advocates cross examined all the witnesses irrespective of the relevance of the evidence to the particular accused so counsel should be comfortable with the evidence led and cross examined at least up until the death of Adv Mngomezulu. legal principles must always be viewed from the perspective of logic and reasonableness. The court must give counsel reasonable opportunity to prepare not absolute or perpetual opportunity.... People read at different speeds and comprehension. Some can read that number of pages in 2 months and some may require more time. People can give all sorts of reasons why 's a delay...The question here should rather be "based on the facts and evidence led, did the court give counsel reasonable opportunity to prepare?" Such opportunity should not be absolute but only reasonable.
