Rule 1102 of the Utah Rules of Evidence allows for "reliable hearsay" as evidence in preliminary hearings, so Graf heard about Kirk's autopsy from Hull instead of a medical examiner. Hull initially said the report stated Kirk's cause of death as "murder," which led to an objection from Robinson's lawyer Kathy Nester. "It's not stated as a murder. I believe it's stated as a homicide, which is an important distinction," Nester said. I learned this when I began reporting on crime for The Spokesman-Review in Spokane, Washington, years ago: Homicide is a person killing another person, while murder implies malice. Not all homicides are murders, some could be legally ruled manslaughter or self defense. A man being shot on stage in front of thousands by a rooftop sniper, which is what prosecutors allege happened to Kirk, seems like obvious murder, but the killing hasn't been legally adjudicated yet. Judge Graf sustained Nester's objection. Prosecutor David Surgill asked Hull to look at the medical examiner's report for the manner of death. "Yes, I misspoke.
