40 years ago there was “intent to commit“ if you were drunk in your car with the keys but they changed that to just DUI,so now put your keys on your air cleaner,close your hood,sleep it off

Arrest is inclined to become the default, per evolution of ‘the law’. I think being within eyesight of a car while intoxicated is grounds for dui &/or grand theft auto charges
