BIG new development in the Lindsay Clancy case. Lindsay Clancy has added veteran Boston attorney Martin Weinberg to her defense team as her lawyers prepare to fight any attempt to put her on trial again. Weinberg is especially notable because he previously represented Karen Read in the legal battle over whether she could be retried after her first trial ended without a verdict. Now he has entered a limited appearance in Clancy’s case specifically to file and argue a forthcoming motion asking that her case be dismissed on double-jeopardy grounds. Clancy’s first trial ended in a mistrial on September 4 after jurors spent seven days deliberating and said they could not reach a unanimous verdict. Several jurors later said the split was 11–1, with 11 supporting a finding that Clancy was not guilty by reason of lack of criminal responsibility and one juror voting to convict. Her longtime attorney Kevin Reddington immediately made clear that the defense would fight a second trial. The defense is expected to argue that the circumstances surrounding the mistrial make another prosecution improper, even though prosecutors are generally allowed to retry a defendant after a hung jury. This is separate from another defense effort already underway asking the judge to enter a not-guilty finding rather than allow another trial. The case is scheduled to return to court on September 29, and prosecutors still have not publicly announced whether they intend to retry Clancy. Adding the attorney who handled Karen Read’s own double-jeopardy fight makes it very clear where Clancy’s defense is heading next. Do you think the judge should allow a second trial after an 11–1 jury split, or should the case end here? #lindsayclancy #karenread #courtnews #truecrime #breakingnews
