The intervention order does not go on your criminal record but a breach will

you may not have a conviction but it still comes up on a police check etc . if you consent it will show up and people don't care of circumstances all they care about is that you agreed to it

Maybe also mention the FLA amendments which provide that DV orders MUST be considered, as well as the circumstances, when making parenting orders, even those made on a w/o admission basis.

I had my explosives ticket revoked when going through court for an IVO against me which ended up being thrown out of court on due to being false. Cost me my job at the time unfortunately

In nsw it is on your record. Whether no breaches or not. It comes back on your police record I’ve seen it first hand with job applications.

Lets face the fact the Court no longer presents fairness a justice for the public. The Court, while bound by law, has chosen administrative comfort over judicial courage. It should not be swayed by political vote chasing laws , rather it should be stand alone to protect the rights of all.

what if the accused posts derogatory memes on their social media and one of their friends comments mentioning the protected person insinuating the meme is about the protected person

What’s your view on the usefulness of “undertakings” in Victoria and how the court deal with this is not followed through on?

and also so many respondents don’t understand that even if the applicant/AFM reaches out to them first (e.g. sends them a text) and they reply, that is still a breach on their part and they can (and often will) be charged

this is how ridiculous the system is. can put people in jail for answering a phone call but hey, run around with a machete threatening to carve people up... you get bail

Can you talk about how someone can keep bringing false ivo’s against someone who has already had one granted for inaccurate reasons. Someone can lie and put you through hell financially

Staggering how many intervention orders are based on rubbish or exaggerated claims.

Definitely different in NSW. I’ve had to advocate for NSWP to charge a breach for intentional harassment and intimidation from my abuser who has done unspeakable things. All I got told was ‘it’s a grey area’ whilst they refused to assist me.
