was it planted or bought? if it was bought, they usually take a limb off a healthy tree and propagate it that way. the limb still thinks is growing like its attached to a tree. some pruning will fix the issue

Diospyros kaki or Diospyros virginiana (American Persimmon) have genetic growth habits that make it grow more horizontal rather than vertical. Wind or seeking sun (etoliation) may also be factors, but at least two persimmon species have this known trait. Pruning helps control the growth directions just trim larger side branches and keep centered upright branches only. It'll thin the tree out the first few years, but be healthier for tree in the long run.

If it’s not to late, before you prune look up air layering. It’s a way of cloning your tree and it’ll produce fruit next year

without seeing the yard, it's probably chasing the sun! also potentially damaged roots on the weak side. depends on how you planted it and received it. do some training pruning in late fall 👍

so this may be a long answer: most fruit trees are grafted, it looks like yours is. the branches that grow beneath the graft line are the root stalk, will overtake the branches that you'd like to grow. prune anything that grows beneath the graft line to promote growth of the grafted tree.
