Yes they technically are, just because the vehicle is off; an impaired person is still controlling the MOVING vehicle. Just like you can get a DUI while on a bicycle; your vehicle does not require a motor.

id say this is acceptable. Much rather be stuck behind a drunk person pushing their car rather than a drunk driver swerving off the road / into people. Much safer. W all the way around.
