‼️ UPDATE|JUDGE EXCLUDES DANIEL'S STATEMENTS HE MADE BEFORE DEATH |LEIGHA MUMBY NEW PHOTOS The case of Fl vs Leigha Mumby for the death of Daniel Waterman , took a turn during a pretrial hearing on September 30, 2026- Circuit Judge Dawn Nichols ruled that Daniel's statements he made on a lettering board could not be presented to a jury Because Daniel passed away before the trial, the defense successfully argued that his accounts constituted hearsay, as he could not be cross-examined under oath I have included below an example of the letter board Daniel used and a message from Daniel's Aunt to me explaining how he would use it Because this was excluded it forced prosecutors to drop the charge of aggravated battery, which they heavily depended on proving Mumby's intent to cause harm While the judge acknowledged the emotional toll this decision would take on Daniel's family, she stated her obligation was to uphold strict rules of evidence Despite the exclusion of Daniel's personal account, Mumby still faces trial for vehicular homicide and reckless driving Prosecutors do not need to prove intent to secure a conviction for vehicular homicide; they only need to establish that she operated the vehicle in a reckless manner that was highly likely to cause death or great bodily harm The state's case will now rely heavily on physical evidence, including the black box data showing full-throttle acceleration into a tree Jury selection is scheduled to begin on October 12, 2026 Daniel's Aunt is currently waiting for requested files and court video to share More updates soon!
