In Canada this would be illegal. You cannot borrow the down payment. You’d actually have to have a legal document stating it is a gift and not a loan

I'm confused because in the US if you don't have the necessary money to buy a house in the bank and another person gives it you it has to be declared as gift - as the bank tracks were the money came from. Unless he had it sitting in his bank account for a certain amount of time (I believe 6 months prior to buying a house or more) then it wouldn't have to be declared as a gift. It wouldn't make sense that they would put it as a loan because that would increase his debt ratio and make him ineligible to buy a house if it's too high or give him a high interest rate. If the contract said loan then that would count against him. He already doesn't have the money plus you add extra debt plus whatever current debt he has = denial of loan.

In Australia its mandatory to have your own legal advice before signing a binding financial agreement. It costs a small fortune but definitely worth it.
