Just so it’s clear to everyone. The guy recording is in the wrong. Yes he is on federal public property; but that property is a restricted and secured area. EVEN AT THAT prisons are not considered public spaces, even if they are publicly or federally funded. Correctional facilities are considered high-security, controlled access locations. Even if grated access as a visitor you must comply with all policies and restrictions(that means listening to an officer when he says stop recording) if you refuse to comply if an officer tells you to stop recording it could result in: immediate removal, being arrested (for: trespassing, obstruction, or other charges.), also whatever your recording them on can be confiscated depending on local laws and facility rules. You cannot keep recording inside a correctional facility if asked to stop. Correctional facilities have the authority to control recording to protect security, privacy, and operational integrity. |Bureau of Prisons Program Statement 1480.05 (“News Media Contacts”): -Media visits and any recording must be pre-approved by the Warden. -Media must obtain written consent from the inmate before photographing or recording their voice. -Unauthorized recording if you’re asked to stop is not allowed. -If you record after being asked to stop, you’re violating both institution policy and federal law possible consequences include removal, device confiscation, trespass charges, or higher penalties.
