When no crime has been committed or is reasonably suspected, police officer presence can function as an intimidation tactic rather than a protective measure. While officer presence is the first step in the use of force continuum and is typically intended to deter crime or de-escalate conflict, its use in situations without legal justification may raise constitutional concerns. The Fourth Amendment protects individuals from unreasonable searches and seizures, and the unwarranted presence of law enforcement may be perceived as coercive, especially in peaceful settings. Without reasonable suspicion or probable cause, such presence may undermine public trust and infringe on civil liberties. Additionally, the First Amendment protects the filming of government officials in public spaces. In Glik v. Cunniffe, 655 F.3d 78, 82 (1st Cir. 2011), the court held that this is a basic, vital, and well-established liberty. Citizens have the right to record public officials, including police, in public settings—an essential mechanism for transparency and accountability in a free society.
