@estateplanlawyer: Replying to @MAMA 🛑 Power of Attorney ends at death — here’s why that matters 🛑 A financial power of attorney or medical power of attorney gives someone authority to act only while the principal is alive. Once they pass away, the power of attorney is no longer valid. It does not let you handle estate matters, access bank accounts, or sell property after death. At that point, only an executor named in a will or a successor trustee in a living trust has legal authority. If there’s no trust or will, the estate may go through probate court, which is time-consuming, expensive, and public. That’s why having a full estate plan—including a revocable living trust, advance healthcare directive, and financial power of attorney—is so important. 💼 Avoid estate planning mistakes. Protect your family. Plan ahead.

my mom passed away and did not leave a will. She had about 700k i a assets. How can we avoid high probate charges? Attorneys are matching what probate is charging.

Our father recently passed & our older sibling keeps using the POA that is void as a weapon in every situation. To benefit financially. He has submitted the POA to property records and signed our mother’s rights over to himself naming him the owner of her home. Please tell me how to resolve this issue & help my mother keep her property

Recent escrow. Property held in join trust with husband and wife who are in assisted living. One spouse has dementia. We could not have the POA sign for the one with dementia so we had to have her removed from the trust as her Dr was out of town and couldn’t be the second medical sign off. Then the other spouse dies prior to closing. Love POA’s . Good info 👍

So how about if a bank account is owned by a trust, but the trust has been updated several times and after the person dies the successor trustee takes it to the bank, but the bank has different information as to who is the successor trustee
