An attorney told a California jury on Monday that the parents of two boys killed by a speeding SUV driver in 2020 should be awarded $439 million to compensate them and their surviving son. Nancy and Karim Iskander Mark Iskander was 11 and his brother Jacob was 8 when Rebecca Grossman struck them in a crosswalk while speeding in her Mercedes-Benz AMG in Westlake Village on Sept. 29, 2020. Plaintiffs’ attorney Brian Panish represents parents Nancy and Karim Iskander and younger brother Zachary Iskander, who was five years old when he witnessed the crash. The claims against Grossman and her boyfriend who was speeding near her, Scott Erickson, include wrongful death and negligence. Los Angeles County Superior Court Judge Huey Cotton granted Panish’s motion for directed verdict on the negligence claims against Grossman, so jurors won’t decide liability, only damages. Panish suggested they award $14 million and $250 in past damages for each boy and $111 million in future damages for each. He also suggested $60 million in emotion distress damages for Zachary Iskander and $100 million for Nancy Iskander. He showed a photo of Zachary with Mark and Jacob and said, “I mean, look at those smiles.” “Never ever will those smiles be seen again for the rest of Nancy, Karim, and Zachary's life, ever, ever,” Panish said. “They should have thought of that before they took the road.” Zachary “has 67 years in the future to think and remember and see his brothers getting killed.” “Time does not heal that wound. Time continues to drag, and he continues to see that he's on flashbacks, nightmares, of course. What would you expect? What would you expect to be someone's reaction? Why should a five year old have to see that?” Panish asked. “Why did Mr. Erickson have to do what he did, and Ms. Grossman, to cause Zachary to go through this? Why did they do that?
