The first thing that comes to mind is that the driver is committing the infraction and he knows that he can’t get the ID from the passenger trying say that the passenger is the one committing the infraction because he is in the vehicle. He is clearly wrong about what he is doing simply trying to violate the passenger rights knowing he only can ID the driver. Because of penal code 3802.the driver is responsible for the infraction not the passengers in any circumstances what is he going to say if there was 10 passengers in the vehicle

This cop needs to go back to kindergarten and start over. He cannot speak nor enforce the laws that he thinks are legit. 6 1/2 weeks in the academy and now he thinks he’s a lawyer.
