Legal Reason to Evict You need a valid reason—like nonpayment of rent, lease violations, or holding over after a lease ends. 2. Serve Notice to Quit - Nonpayment of Rent: Give a 10-day notice to pay or vacate. - Lease Violation: Give a notice to cure or quit (reasonable time to fix the issue or leave). - No Lease or End of Lease: Give 7-day notice (week-to-week) or 30-day notice (month-to-month). 3. File for Summary Ejectment If the tenant doesn’t comply, file a Complaint in Summary Ejectment at the small claims court (Magistrate Court) in the county where the property is. 4. Court Hearing A hearing is scheduled within 7 days of filing. You present your case to a magistrate. 5. Judgment & Writ of Possession If you win, the tenant has 10 days to appeal. After that, you can request a Writ of Possession. The sheriff posts notice and returns after 7 days to remove the tenant if they haven’t left. 6. Eviction Enforcement The sheriff physically removes the tenant if necessary.
