In court, this argument could go either way. He instinctively reached for it so that it wouldn’t fall out of his pants on the ground. Even though the cop is technically still within the law for shooting him because he reach for a gun, he could have waited to shoot him when there was an actual threat. The guy was running away. He didnt have eyes in the back of his head. If a homeowner shoots someone that broke into his house in the back, but they are running away, the homeowner could be charged. But cops have body cams, so it could also be argued that the guy running could turn around and shoot really fast, so it’s not worth the risk. I bet this went to court
