at the end of the day, the guy can say anything he wants because first amendment. including racism and cursing. however he was trespassed, so as long as he continued to leave he was fine legally. the moment he stopped at the elevator and didn't continue to leave is when the officers now had a right to go hands on and arrest him for criminal trespass. that was his legal mistake.
