I’m not saying he should or shouldn’t but Just because he signed a waiver doesn’t mean he can’t sue. That doesn’t release them to allow them to be negligent. That’s like parking a dozer over a blind landing. You wouldn’t assume that’s a risk. Can totally sue for that because it’s negligence and not part of the assumed risk that the waiver would outline.
