Government does not have to pay out for wrongful arrests. The member should pay ftom his/her own pocket, pension, medical aid funds etc. The ministers and politicians should pay out of their pockets.

as long as the suspects have more rights than the police, then lawsuits will come more and more. So with this law structure, for SAPS to avoid lawsuits, Let main duties be certifying and writing affidavits. Coz the law favors civil claim than police duties . Police are not protected

These lawsuits are the reason why police officers let criminals walk, proving someone is guilty is no walk in the park, as soon as that not guilty verdict is read, you have lawyers waiting to pounce to sue the state. Rather certify and write affidavits

During covid i was arrested in Polokwane for not having a permit to go see a patient in hospital I slept in jail 😭

I was wrongfully arrested in Pretoria in my shop and I spent 4 days in policestation cells and I was released after long weekend. When I get back home my shop was empty but I didn't know anything about law and I left Pretoria for good.
