Hi. Realtor here. Her fence was on her property. That is not a problem. Nor is your problem. She should have done her survey during her due diligence period not after the purchase was complete. Her fault her problem. Don’t go to her for real estate advice! 😂.

This is very simple legally speaking: the fence is on her property, therefore it’s her property.

You better than me because I would’ve left that fucking fence up and she could’ve dealt with it with the old owners of the house

Fences built entirely on one property belong to the owner of that property. But fences on a boundary line belong to both property owners unless they a

All she has to do is remove the fence, since it's on her property, she could do that...lol But, it's not up to you to build a new one. 1/2

yes, it actually is your fault. you should have never torn it down. it wasn't yours or your responsibility. she bought it when she bought the house. it was hers. you let her bully you into something you didn't want to do, and should not have done. she probably can make you put up a new fence now or replace the old one. it would be her word against yours. f'd up.

When she threatened to sue you, you should’ve let her sue you. Why because when she purchased that house from the previous owner that fence became her property. So if you don’t have any type of recording telling you to destroy her property you kinda are in a pickle you should’ve let her take you to court and then you should’ve charged her for court fees, etc. because it was her fence on her property. I hope this helps.

Oh, you messed up. I bet you have none of that conversation with her in writing at this point, you trespassed on her property and you tore up her property. You should have left her fence alone. It’s hers her problem, her fence her situation.
