He can see everything the drone can from where he is standing so how’s that meet any of these standards. What is he recording that he can’t see from public then. Cameras can voom in way further than his property line. He didn’t fly over a privacy fence

This isn’t actually protected if he’s recording with it. He can fly, usually, above 400ft if meeting FAA regs- below if not, and usually, only if he’s not recording. If he is- it doesn’t matter how high he goes. A reasonable expectation of privacy exists and photographing/recording with the use of an overhead drone on the inner portions of such a property is usually an infringement on their right to privacy on their property. If you’re not recording, you can pretty much do whatever you want above the property so long as what you’re doing wouldn’t constitute harassment or some other invasion of privacy. Most of the time, if you’re sitting over someone’s home for extended periods of time, this is likely to be considered harassment. This guy self-admitted to photographing, and is very likely invading their privacy. That isn’t protected.
