Replying to @vanessa.chauhan Occupational Health recommended an adjustment... and your employer completely ignored it. What now? 🩺👀 First, remember: An Occupational Health recommendation is advice, not an instruction. Your employer doesn’t automatically have to implement everything OH recommends. ⚖️ But there’s a big difference between: ❌ Considering the recommendation and deciding, for legitimate reasons, that it isn’t appropriate or reasonable. and 🚩 Completely ignoring it. I’d expect an employer to actually consider the medical advice, look at whether the recommendation could work and, if they decide against it, be able to explain their reasoning. This becomes particularly important where the employee may be disabled under the Equality Act and the recommendation relates to a potential reasonable adjustment. If your OH report appears to have disappeared into a black hole, challenge it in writing. 📧 Ask: Has this recommendation been considered? If it has been rejected, what are the reasons? Were any alternative adjustments considered? You might not be entitled to the exact recommendation OH suggested. But you’re in a much stronger position when you make the employer clearly explain what they considered and why they decided against it. 🎯 #occupationalhealth #reasonableadjustments #disabilityatwork #employmentlaw #hradvice
