They did this to me. I’m looking into suing the Mortgage company who pulled my credit for a loan when I explicitly said I did not want to be on the loan. Sure enough, I was listed and the borrower.

I’m pretty sure that only applies for a “hard inquiry” or a “hard pull”. There are “soft pulls”, prequalifying inquiries, fraud inquiries, and marking inquiries which are credit checks that are not required to report back to the bureaus that an inquiry was made. Bureaus offer these data sets as inquiries that sit outside of FCRA (Fair credit reporting act). Most background checks do not include a hard inquiry, but are usually “identity verification” data sets, which provide even more detail about you than a hard inquiry can contain. It’s also incredibly easy to get a credit score/report without doing a hard inquiry.
